Muslims can't commit suicide-bombings in mosques: Claim right-wing politicians !

Jamrud Mosque attack: read the message!

A mosque housing nearly 300 people who were saying their Friday prayers was attacked by a suicide-bomber, killing 70 and crippling 125. The reaction of the political agent of Khyber was that “the attackers could not be Muslims because Muslims would never attack a mosque and that a Muslim would never spill the blood of a Muslim, especially when he was saying his namaz”. This statement flies against the worldwide evidence of Muslims at sectarian and national war with and against each other in many different places and at different times in history. Most regrettably, the conclusion thereafter drawn by some TV anchors was that a “foreign” non-Muslim power had staged the attack to destabilise Pakistan. Of course, one can only read “India” into this allegation, which is not very original.

The political agent said something else of interest without making the necessary connections himself, possibly for reasons of simplicity of mind or just fear. He said the attack came because the mosque was next to the checkpost of Baghiari and that among the people killed were many “khasadars”, or local levies, standing guard at the checkpost, a number of whom had been killed in the attack while praying. Later, a government official, who was less opaque about what had happened, clearly accused the Taliban of having done the job in retaliation against a recent operation by the khasadars and other security personnel targeting a militant group in Khyber that owed allegiance to Baitullah Mehsud, the self-proclaimed leader of the Tehreek-e Taliban Pakistan.

When Pakistanis say that “Muslims can’t do this or that” in or out of Pakistan, they are being hypocritical. There are all sorts of Muslims, moderates and extremists, Sufis and Wahabis, and so on. The fact also is that some sorts of Muslims have been killing other sorts of Muslims from Algeria to Iraq to Afghanistan and Pakistan for the past two decades. They dynamite sacred mausoleums, they blow up mosques and routinely kill other Muslims in the act of praying. What is happening in Pakistan today is serious violence against the state of Pakistan by local warlords who are affiliated with the Taliban who in turn are linked up with Al Qaeda. We may have weak resolve to take on the enemy but there is no validity in the assertion that we don’t know who is killing us. (Daily Times, 29 March 2009)

One can find following statements in the attached news report of Daily Express

*Shareef Brothers said “No Muslim or Pakistani can play Holi with innocent Muslims’ blood in a mosque”.
* Leaders of Jamaat-e-Islami Qazi Hussain and Munawwar Hassan said “those who blew up mosques and religious seminaries can never be Muslims and hidden hand of Pakistan’s enemies must be involved in this incident”.
* Moulana Fazl-ur-Rehman, Abdul Ghafoor Haideri and a federal minister Azam Khan Swati “blamed American CIA for this suicide bombing”.
* Imran Khan said that “No Muslim can commit such a heinous crime”.
* Tahir-ul-Qadri claimed “Terrorists are enemies of humanity and they have no religion”

After every suicide bombing we hear and read such statements of our right-wing politicians and mullahs.

While our own indigenous terrorist organizations such as Tehreek-e-Taliban Pakistan (TTP) and Lashkar-e-Jhangvi have claimed responsibilities of several suicide bombings, it is really shameful on part of our politicians and mullahs that they instead of condemning those who have been actually claiming responsibilities of suicide bombings and running training camps for the training of terrorists and suicide bombers, they always point fingers towards “some hidden hand”, “agents of RAW or CIA”, “enemies of Islam and Pakistan” and “ Christian crusaders and Jews”.

Why don’t our right-wing politicians and mullahs simply condemn Talibans and their associate terrorists and sectarian organizations who have been claiming responsibilities of suicide bombings???

Why don’t our right-wing politicians, mullahs and even so-called civil society activists mobilize masses and organize rallies and public meetings for the condemnation of crimes against humanity by Taliban terrorists and their associates terrorists of Lashkar-e-Jhangvi?
Shame on our right-wing politicians and mullahs ! (Socrates)

Terrorists have no religion
By ALI IRTIZA RIZVI
‘People-sans-religion’ have yet again struck. So far 70 people are feared dead in the Khyber Agency suicide attack. I am sad, but what makes me sadder as well as pessimistic is that a majority of Pakistanis are yet again bent upon avoiding the main point: instead, they are justifying the act and blaming the ‘enemies of Pakistan and Islam’ for the act. The immediate statements that are repeated in the media after such heinous acts speak of ‘an unknown suicide bomber’, the ‘enemies of Pakistan’, the ‘enemies of Islam’, ‘such people cannot be Pakistanis’, ‘such people cannot be Muslims’, so on and so forth to be behind the crime. Many political analysts after much deliberation and contemplation tend to reach the same, and oft-repeated, conclusion that India, Israel and covertly America are on a crusade against Pakistan. The people of Pakistan have nothing to do with terrorism, they say. Not a single Pakistani has been identified as a terrorist. Pakistan has itself been a victim of terrorism. This to me is nothing but rubbish. The painful realisation is that when the self-proclaimed divine soldiers bomb a mosque or kill innocent civilians, they are given a clean sheet. The aforementioned vague statements are issued in order to create ambiguity or to cover up the identity of the terrorists. But when the same people force the government to bow down to their demands for the implementation of their version of the Shariah, it is celebrated as the victory of Islam. However, when military action is initiated against such elements, the pro-Taliban media, especially anchor persons and so-called analysts, and the religious parties create an uproar and an environment of uncertainty for the masses who succumb to the propaganda. If these suicide attacks are seen in the light of a foreign hand that is determined to make Pakistan unstable, that foreign power is probably using these religious fanatics to fulfill its malicious designs, which plausibly make these religious fanatics (Taliban, Al Qaeda, or the many Lashkars and Hizbs) Indian allies, and foes of Pakistan. Why is it that when the government of Pakistan carries out military action against these elements that are allegedly Indian agents in Pakistan, considering the action to be in the best interest of Pakistan and guaranteeing Pakistan’s survival, there is an uproar from the religious and some political parties and media personnel against it? Should we assume that the religious parties in Pakistan, and their allies and friends, from the politicians to mullahs and the military to the media, are all Indian agents or at least the enemies of Pakistan? Why do such conspiracy theories fascinate us? There is always a need to put the record straight. The simple chronology of events in this regard is that under the US cover, taking advantage of its involvement during the Soviet invasion, Pakistan bred these terrorists and used them on either side of the border. This continued even in the post-9/11 period, and the same flawed ideology and strategy are being applied even today. It needs to be admitted that this is a problem created by Pakistan itself, supported by its ideological allies, and the pawns used in this game have been Muslims. The suicide bombers and their cohorts are also Muslims, and mostly Pakistanis. We should admit our mistakes. Though this may not solve the problem, the problem should be identified at least.

Dear Moderators,

Muslims are not allowed [as per Quran and Hadith] to carry Suicide Attacks even against the Combatant 'Infidel' Army because means of Jihad must be under the guidance of Quran and Hadith and as per Quran and Hadith:

Suicide Attacks, Psychological Warfare [even if it is against the Enemy but must be aimed at combatants not the Non-Combatants], Hijakcing, Robbery, Kidnappings, Time Bombing.etc.etc. are Haraam in the light of Clear Text of Quran and Hadith:

For example

Most of the people killed in these attacks were Muslims either in Iraq, Afghanistan, Pakistan or Saudi Arabia. Most of the Non-Muslims who were killed in these attacks were non-combatants [means the whoever is committing such act if they are Muslims than they have committed a Kufr-Infidelity] . Calculate the number of people killed in these attacks since the start of War on Terror and you will be amazed to know that most of the people who are killed were Muslims.

These are the excerpts of the debate [in Saudi Arabia] on such issues

"QUOTE"

All Praise is for Allaah Alone, may the Salaah and Salaam be upon the last Prophet and his family and Companions. To proceed:

And it is well known that the Sharee'ah of Islaam came to protect the five necessary things and prohibit transgression against them, and they are:

the religion,

life,

wealth,

honour, and

intellect.

And the Muslims do not differ over the prohibition of transgression against persons who have a right to be protected. The people who have a right to be protected, according to the Religion of Islaam, are:

Muslims - It is never permissible to transgress against any Muslim person or to kill one without right. Whoever does this has committed a major sin, one of the huge kabaa’ir! And Allaah the Most High has said:

And whoever kills a Muslim intentionally, then his recompense is Jahannam, he will reside there for an extensive amount of time, and Allaah’s Anger and Curses are upon him, and He has prepared a great torment for him...

...And He Subhaanahu has said:

And due to that we prescribed for the Children of Israa’eel that whoever kills a person, not as a recompense for his killing of another, or to spread corruption on earth, then it is as if he has killed all of mankind... the verse

Mujaahid said, may Allaah have Mercy on him, ((by his sin (meaning: “His sin is as heavy as the one who has actually killed all of mankind), this shows the severity of killing a person with no due (legal) right))

And the Prophet (sal-Allaahu `alayhe wa sallam) said:

The blood of a Muslim that bears witness that none has the right to be worshipped (in truth) except Allaah and that I am the Messenger of Allaah is not permissible (to spill), except in three cases:

recompense for killing someone else,

stoning the adulterer,

the one who leaves his Deen, abandoning the jamaa’ah [Agreed upon (Bukhaaree and Muslim)] This is the version of Bukhaaree.

And the Prophet (sal-Allaahu `alayhe wa sallam) said:

I have been ordered to fight the people until they testify that there is no deity worthy of worship other than Allaah and that Muhammad is the Messenger of Allaah, establish the prayer, and pay zakaat, and if they do this, then their blood and money shall be protected from me, except by an Islaamic right, and their account will be with Allaah. [Agreed upon, from the hadeeth of Ibn ‘Umar, may Allaah be pleased with him]

And in the Sunan of An-Nasaa’ee, on the authority of ‘Abdullaah ibn ‘Amr, (radhi-yallaahu 'anhu), the Prophet (sal-Allaahu `alayhe wa sallam) said:

The cessation of the dunyaa (world) is less significant to Allaah than the killing of a single Muslim man (i.e. person)

And one day, Ibn ‘Umar looked to the House, or the Ka'bah, and said:

"How great you are, and how great is your sanctity, and the believer is even greater in sanctity to Allaah than you" (Meaning that the haram is safe and protected from fighting and bloodshed, and the believer has even more right to be safe and protected
from bloodshed)

All of these texts and others show the serious reality of the sanctity of a Muslim’s blood, and the prohibition of killing a Muslim for any reason other than what has been mentioned in the Sharee'ah’s texts, so it is not permissible to transgress against any Muslim without right...

Usaamah bin Zaid reported,

“Allaah’s Messenger sent us towards Al-Huruqa, and in the morning we attacked them and defeated them. I and an Ansari man followed a man from among them and when we overwhelmed him, he said, “La ilaha illal-Lah.” On hearing that, the Ansari man stopped, but I killed him by stabbing him with my spear. When we returned, the Prophet (sal-Allaahu `alayhe wa sallam) came to know about that and he said:

"O Usaamah! Did you kill him after he had said “La ilaha ilal-Lah?” I said, “But he said so only to save himself.” He kept on repeating that so often that I wished I had not embraced Islaam before that day. [Agreed upon, and this is the wording of Bukhaaree]

This shows, with the greatest of indications, the sanctity of life. This was a mushrik man, and they were making jihaad, on the plains of battle (fighting), and when they overwhelmed him, and gained power over him, he spoke with (the utterance of) Tawheed, and Usaamah bin Zaid killed him, holding that he only said it in order to prevent his own death, and the Prophet (sal-Allaahu `alayhe wa sallam) did not accept his excuse, and his interpretation (of the situation). And this is from the greatest of (affairs) that indicates the sanctity of the blood of the Muslims and the mighty crime of the one who violates it.

Just like the blood of the Muslims is prohibited, then their wealth is also protected by the saying of the Prophet (sal-Allaahu `alayhe wa sallam):

"Your blood and your properties are sacred to one another like the sanctity of this day of yours, in this (sacred) town (Mecca) of yours, in this month of yours."

Reported by Muslim, and this speech was said by the Prophet (sal-Allaahu `alayhe wa sallam) in the khutbah of the Day of 'Arafah, and both Bukhaaree and Muslim reported its like regarding the Day of An-Nahr.

From what has preceded, the prohibition of killing the soul that has been protected without any due right becomes clear.

Also from the lives that are protected in Islaam, are the lives of

those (non-Muslims) who are given agreements (guarantees) ,

the dhimmees, and

those who seek protection (from the Muslims).

From ‘Abdullah bin Amr bin al-Aaas (radhi-yallaahu 'anhumaa) from the Prophet (sal-Allaahu `alayhe wa sallam) who said:

"Whoever killed a person having a treaty with the Muslims, shall not smell the smell of Paradise though its smell is perceived from a distance of forty years." [Related by al-Bukhaaree]

And to whomever the wali ul-amr allows entry (into the land) with the covenant and promise of ensuring his safety and security, then his life and wealth are protected, it is not permissible to harm him, and whoever kills him, then he is as the Prophet
(sal-Allaahu `alayhe wa sallam) said:

"...he will not smell the smell of Paradise..."

And this is a very severe warning for the one who turns upon those who have been given agreements.

And it is known that the custody (protection) of the people of Islaam is a single entity (i.e. a collective whole, equal), the Prophet (sal-Allaahu `alayhe wa
sallam) said:

"The blood of the Believers is equal (one to another), and the least of them strives for their protection.. ."

And when Umm Haani (radhi-yallaahu 'anhaa) granted sanctuary (i.e. protection, on account of a benefit arising from that) to a man from the Mushrikoon in the year of the conquest, and when 'Alee bin Abee Taalib (radhi-yallaahu 'anhu) desired to kill him, she went to the Prophet (sal-Allaahu `alayhe wa sallam), and informed him (of that) so he (sal-Allaahu `alayhe wa sallam) said:

"We have granted sanctuary to the one you have granted sanctuary O Umm Haani." Reported by Bukhaaree and Muslim.

The intent here is that the one who entered (the land) with an agreement of personal security, or who had a pledge from the one in authority, due to a maslahah (benefit) that he (the one in authority) saw (in giving this person that pledge), then it is not permissible to turn upon him and nor to transgress upon him or his wealth.

When all of this has become clear, then what occurred of the bombing incidents in the city of Riyadh is a prohibited matter that the religion of Islaam does not affirm, and its unlawfulness has come from numerous angles:

That this action is a transgression upon the sanctity of the land of the Muslims, and frightening of those who are secure and safe therein

That it contains the killing of lives that the Islaamic Sharee'ah protects

That it is causing corruption upon the earth

That it contains destruction of wealth and belongings that are protected.

And the gathering of the Council of Senior Scholars explains this matter in order to warn the Muslims from falling into the destroying prohibited matters, and in order to warn them from the plots of Shaytaan, for he never ceases to work upon the servant until he enters him into the things that destroy, either with extremism, exaggeration in the religion or with disaffection towards it, and fighting against it, and refuge is with Allaah. And Shaytaan does not care by which of the two he can triumph over the servant, because both of these paths, that of extremism and that of disaffection are from the paths of Shaytaan that make a person fall under the wrath and punishment of ar-Rahmaan.

And what was done by those who performed these actions, of killing themselves by blowing themselves up, then that enters into the generality of the saying of the Prophet (sal-Allaahu `alayhe wa sallam):

"Whoever killed himself in the world with anything, then Allaah will punish him by that same thing on the Day of Judgement", reported by Abu Awaanah in his Mustakhraj from the hadeeth of Thaabit bin ad-Dahak, (radhi-yallaahu 'anhu).

The Prophet (sal-Allaahu `alayhe wa sallam) said:

"He who commits suicide by stabbing himself with an iron (blade) shall that have that iron (blade) in his hand, and he will thrust it into his body in the fire of Hell, remaining therein forever (in that state), and whoever took poison and killed himself, then he will drink it in the Fire of Hell, remaining therein forever (in that state), and whoever threw himself off a mountain and killed himself, then he will be falling in the Fire of Hell, remaining therein for ever (in that state)." And this is also in Bukhaaree with something similar.

Then let everyone know that the enemies, from every angle, have designated today the Islamic Ummah for domination. They (the enemies) rejoice with all the ways that justify this domination for them, over the people of Islaam, and (which justify) humiliating them, and taking advantage of their resources and riches. Hence, whoever aided them in their goal, and opened up avenues amongst the Muslims and in the
Muslim lands for them, then he has aided in (bringing about) harm upon the Muslims and in dominating their lands. This is from the greatest of oppression.

It is obligatory (upon all) to be concerned with the Sharee'ah knowledge that is founded upon the Book and the Sunnah in accordance with the understanding of the (Pious) Predecessors of the Ummah, and this occurs in the schools, universities and the mosques, and the media of information. Just like it is also obligatory to be concerned with commanding the good and prohibiting the evil, and giving mutual advice upon the truth. This is because the need, rather the necessity, calls to this now more than any time that has passed before. And it is upon the Muslim youth to have a good opinion of their Scholars and to take from them so that they come to know that what the enemies of the religion are striving towards is revilement between the Ummah’s youth and (revilement) of the Scholars and (revilement) between them and the Rulers, so that their strength weakens, and therefore, taking control over them (as a result) becomes easier. Hence, it is obligatory to be aware of this.

May Allaah protect everyone from the plot of the enemies, and it is upon all the Muslims to have fear of Allaah in the secret and in the open, and to make a sincere, truthful repentance from all sins. For no calamity has descended except due to a sin, and no (calamity) has been raised except due to repentance. We ask Allaah that He rectifies the condition of the Muslims, and distances the lands of the Muslims from every evil and dislikeable thing, and prayers and peace be upon our Prophet Muhammad, his family and his companions.

Since question of Militancy amongst Muslim has been raised let me clear that once and for all. Warring groups in Pakistan claim to have Islam as their Religion and now read as to what Islam says about when Groups of Muslims fight and kill each other [when you cannot even start against Non-Muslims] . Its quite pathetic for Muslims like us that they dont even know the basic teachings of their own religion but hell bent to spread Islam around globe. Please keep in mind while reading that Muslims are fighting each others and then judge. Many amongst who are killed since 911 in Pakistan were Muslims either law enforcers or attackers or innocent bystanders.

2) stoning the adulterer,

3) the one who leaves his Deen, abandoning the jamaa’ah)) [Agreed upon (Bukhaaree and Muslim)] This is the version of Bukhaaree.

WHEN TWO MUSLIMS CONFRONT EACH OTHER WITH SWORDS

Ahnaf b. Qais reported on the authority of Abu Bakra that Allah's Messenger (may peace be upon him) said:

When two Muslims confront each other with their swords, both the slayer and the slain are doomed to Hell-Fire.

This hadith has been narrated on the authority of Hammad through another chain of transmitters.

Abu Bakra reported Allah's Messenger (may peace be upon him) as saying:

When two Muslims (confront each other) and the one amongst them attacks his brother with a weapon, both of them are at the brink of Hell-Fire. And when one of them kills his companion, both of them get into Hell-Fire.

Abu Huraira reported Allah's Messenger (may peace be upon him) many ahadith and one of them was this:

The last Hour will not come until the two parties (of Muslims) confront each other and there is a large-scale massacre amongst them and the claim of both of them is the same.

Abu Huraira reported Allah's Messenger (may peace be upon him) as saying: The last Hour will not come unless there is much bloodshed. They said: What is harj? Thereupon he said: Bloodshed. bloodshed.

Thauban reported that Allah's Messenger (may peace be upon him) said: Allah drew the ends of the world near one another for my sake. And I have seen its eastern and western ends. And the dominion of my Ummah would reach those ends which have been drawn near me and I have been granted the red and the white treasure and I begged my Lord for my Ummah that it should not be destroyed because of famine, nor be dominated by an enemy who is not amongst them to take their lives and destroy them root and branch, and my Lord said: Muhammad, whenever I make a decision, there is none to change it. Well, I grant you for your Ummah that it would not be destroyed by famine and it would not be dominated by an enemy who would not be amongst it and would take their lives and destroy them root and branch even if all the people from the different parts of the world join hands together (for this purpose), but it would be from amongst them, viz. your Ummah, that some people would kill the others or imprison the others.

'Amir b. Sa'd reported on the authority of his father that one day Allah's Messenger (may peace be upon him) came from a high, land. He passed by the mosque of Banu Mu'awiya, went in and observed two rak'ahs there and we also observed prayer along with him and he made a long supplication to his Lord. He then came to us and said: I asked my Lord three things and He has granted me two but has withheld one. I begged my Lord that my Ummah should not be destroyed because of famine and He granted me this. And I begged my Lord that my Ummah should not be destroyed by drowning (by deluge) and He granted me this. And I begged my Lord that there should be no bloodshed among the people of my Ummah. but He did not grant it.

Amir b. Sa'd reported on the authority of his father that Allah's Messenger (may peace be upon him) came with a group of his Companions and he passed by the mosque of Banu Mu'awiya. The rest of the hadith is the same. [Translation of Sahih Muslim, Book 41: The Book Pertaining to the Turmoil and Portents of the Last Hour (Kitab Al-Fitan wa Ashrat As-Sa`ah)]

These Deviant Militants have always got the plea that they are Seeking revenge.

But from whom? Innocent Bystanders like e.g. Children Killed in Lahore last year near FIA Office, innocent people died on 18 Oct 2007 in Karachi, Nishter Park Blast Karachi two years ago, or those who died in Funeral Procession [Shias Funeral as well] etc.etc. By the way most of those [almost 95%] who were killed were Muslims.

[The Almighty] will say:

And what did you do about them? He will say: I studied [religious] knowledge and I taught it and I recited the Quran for Your sake. He will say: You have lied - you did but study [religious] knowledge that it might be said [of you]: He is learned. And you recited the Quran that it might be said [of you]: He is a reciter. And so it was said. Then he will be ordered to be dragged along on his face until he is cast into Hell-fire.

[Another] will be a man whom Allah had made rich and to whom He had given all kinds of wealth. He will be brought and Allah will make known to his His favours and he will recognize them.

[The Almighty] will say:

And what did you do about them? He will say: I left no path [untrodden] in which You like money to be spent without spending in it for Your sake. He will say: You have lied - you did but do so that it might be said [of you]: He is open-handed. And so it was said. Then he will be ordered to be dragged along on his face until he is cast into Hell-fire.

It was related by Muslim (also by at-Tirmidhi and an-Nasa'i).

These acts of violence are to be punished as per the Mullah Laws:

Since 911 many amongst who died in such incidents were Children and Women in Pakistan and around the world as well:

For that cause We decreed for the Children of Israel that whosoever killeth a human being for other than manslaughter or corruption in the earth, it shall be as if he had killed all mankind, and whoso saveth the life of one, it shall be as if he had saved the life of all mankind. Our messengers came unto them of old with clear proofs (of Allah's Sovereignty) , but afterwards lo! many of them became prodigals in the earth. [AL-MAEDA (THE TABLE, THE TABLE SPREAD) Chapter 5: Verse 32]

It is narrated on the authority of 'Abdullah that a woman was found killed in one of the battles fought by the Messenger of Allah (may peace be upon him). He disapproved of the killing of women and children. [Muslim]

It is narrated by Ibn 'Umar that a woman was found killed in one of these battles; so the Messenger of Allah (may peace be upon him) forbade the killing of women and children.[Muslim]

Even in a declared war, certain rules must be followed:

The Holy Prophet (may peace be upon him) has given clear instructions about the behaviour of the Muslim army. He observed:

"Set out for Jihad in the name of Allah and for the sake of Allah. Do not lay hands on the old verging on death, on women, children and babes. Do not steal anything from the booty and collect together all that falls to your lot in the battlefield and do good, for Allah loves the virtuous and the pious."

So great is the respect for humanly feelings in Islam that even the wanton destruction of enemy's crops or property is strictly forbidden. The righteous Caliphs followed closely the teachings of Allah and those of His Apostle in letter and spirit the celebrated address which the first Caliph Abu Bakr (Allah be pleased with him) gave to his army while sending her on the expedition to the Syrian borders is permeated with the noble spirit with which the war in Islam is permitted. He said:

"Stop, O people, that I may give you ten rules for your guidance in the battlefield. Do not commit treachery or deviate from the right path. You must not mutilate dead bodies. Neither kill a child, nor a woman. nor an aged man. Bring no harm to the trees, nor burn them with fire, especially those which are fruitful. Slay not any of the enemy's flock. save for your food. You are likely to pass by people who have
devoted their lives to monastic services; leave them alone"

It is said that once at the time of conquest, a singing girl was brought to al-Muhajir b. Abu Umayya who had been publicly singing satirical poems about Hadrat Abu Bakr. Muhajir got her hand amputated. When the Caliph heard this news, he was shocked and wrote a letter to Muhajir in the following words:

"I have learnt that you laid hands on a woman who had hurled abuses on me, and, therefore, got her hand amputated. God has not sought vengeance even in the case of polytheism, which is a great crime. He has not permitted mutilation even with regard to manifest infidelity. Try to be considerate and sympathetic in your attitude towards others in future. Never mutilate, because it is a grave offence. God purified Islam and the Muslims from rashness and excessive wrath. You are well aware of the fact that those enemies fell into the hands of the Messenger of Allah (may peace be upon him) who had been recklessly abusing him; who had turned him out of his home; and who fought against him, but he never permitted their mutilation."

Another letter written by hadrat 'Umar the Second Caliph, which is addressed to Sa'd b. Abu Waqqas, speaks eloquently of the noble spirit with which the Muslims have bear exhorted to take up arms:

"Always search your minds and hearts and stress upon your men the need of perfect integrity and sincerity in the cause of Allah. There should be no material end before them in laying down their lives. but they abould deem it a means whereby they can please their Lord and entitle them. selves to His favour: such a spirit of selflessness should be inculcated in the minds of those who unfortunately lack it. Be firm in the thick of the battle as Allah helps man according to the perseverance that he shows in the cause of His faith and he would be rewarded in accordance with the spirit of sacrifice which he displays for the sake of the Lord. Be careful that those who have been entrusted to your care receive no harm at your hands and are never deprived of any of their legitimate rights."

WHAT IS GOING ON IN PAKISTAN IS HIRABA [means killing people, robbing their money or raping women by an armed group of people]

The Punishment for such activities are as under:

The crime of hiraba is based on the following Quranic verse:

The punishment for those who wage war [yuharibuna] against God and His Prophet, and perpetrate disorders in the land is: kill or crucify them, or have a hand on one side and a foot on the other cut off or banish them from the land (Quran 5:33).

Hands and legs to be cut off and their eyes to be branded with heated iron pieces and they were thrown at Al-Harra, and when they asked for water to drink, they were not given water. (Bukhari)

Hiraba is another hadd crime defined in the Quran. It is variously translated as "forcible taking," "highway robbery," "terrorism," or "waging war against the
state."

Islamic legal scholars have interpreted this crime to be any type of forcible assault upon the people involving some sort of taking of property.74 It differs from ordinary theft in that the Quranic crime of theft (sariqa) is a taking by stealth whereas hiraba is a taking by force (Doi 1984, 250, 254; El-Awa 1982, 7). (Thus, the popular translation as "armed robbery.") Although it is generally assumed to be violent public harassment, many scholars have held that it is not limited to acts committed in public places (Sabiq 1993, 2:447).

It is in the discussions of the crime of hiraba where the crime of rape appears. A brief review of the traditional descriptions of hiraba reveals that rape is specifically included among its various forms. For example, in Fiqh-us-Sunnah, a modern summary of the primary traditional schools of thought on Islamic law, hiraba is described as: a single person or group of people causing public disruption, killing, forcibly taking property or money, attacking or raping women ("hatk al arad"), killing cattle, or disrupting agriculture (Sabiq 1993, 450). Reports of individual scholars on the subject further confirm the hiraba classification of rape.

Al-Dasuqi, for example, a Maliki jurist, held that if a person forced a woman to have sex, their actions would be deemed as committing hiraba (Doi 1984, 253). In addition, the Maliki judge Ibn Arabi, relates a story in which a group was attacked and a woman in their party raped. Responding to the argument that the crime did not constitute hiraba because no money was taken and no weapons used, Ibn Arabi replied indignantly that "hiraba with the private parts" is much worse than a hiraba involving the taking of money, and that anyone would rather be subjected to the latter than the former (Sabiq 1993, 2:450). The famous Spanish Muslim jurist, Ibn Hazm, a follower of the Zahiri school, reportedly had the widest definition of hiraba, defining a hiraba offender as: [O]ne who puts people in fear on the road, whether or not with a weapon, at night or day, in urban areas or in open spaces, in the palace of a caliph or a mosque, with or without accomplices, in the desert or in the village, in a large or small city, with one or more people . . . making people fear that they'll be killed, or have money taken, or be raped ("hatk al arad") . . . whether the attackers are one or many (Sabiq 1993, 2:450)."

Following the suicide blast in Islamabad on March 23 when a lone bomber took on the headquarters of the Special Branch, managing only to kill himself and one other, Malik admitted that he had information that there would be attacks and that Baitullah Mehsud had infiltrated into the area a score or so of Tehrik-i-Taliban youths in search of paradise. Routine condemnation came from the presidency and government, and Advisor Malik swore to deal with ‘them’ with an iron hand — empty words spouted by those who have neither the will nor the way.

Baitullah Mehsud was also at work on March 26 in Jandola when one of his brainwashed paradise-seekers blew himself up killing 12 in a crowded bazaar area. Then we come to Jamrud, just up the road from Peshawar where on March 27, in a mosque, at Friday prayers, over 50 praying people died, murdered by a fellow Muslim, a loyal Taliban.
